These Terms & Conditions govern your use of www.ByTheHarrisFamily.com (“the Website”) and any purchases, services, information or content made available through the Website.

The Website By The Harris Family is operated by Kruidenier Investments, with commercial products and activities offered under the Stay Salty trading name and any other brands or product ranges that may be introduced from time to time.

Throughout these Terms, “we”, “us” and “our” refer to Kruidenier Investments, where the context relates to the operation of the Website, sale of products or provision of commercial services.

Salt and Seed Foundation is a separately registered nonprofit organisation and is legally separate from Kruidenier Investments and Stay Salty. Where this Website contains information about, links to or opportunities to support Salt and Seed Foundation, those activities are identified separately.

By accessing or using this Website, creating an account, placing an order, submitting information or otherwise interacting with the Website, you agree to these Terms & Conditions together with our Privacy Policy, Shipping & Delivery Policy and Returns & Refunds Policy.

Nothing in these Terms is intended to exclude, restrict or waive any rights or remedies that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), or any other applicable South African law.

By The Harris Family is the name of our website and online platform. It brings together different parts of our family’s work and story, centred around faith, food, family and community.

Commercial products sold through the Website are offered by Kruidenier Investments, trading as Stay Salty, unless a particular product or service clearly states otherwise.

The Website may include, amongst other things:

We take reasonable care to describe and photograph our products as accurately as possible.

However, colours and appearance may vary slightly depending on photography, lighting, manufacturing variations and the screen or device on which products are viewed.

Where products are handmade, baked, blended, printed, sewn or produced in small batches, minor natural variations may occur between individual products.

Product descriptions, packaging, ingredients, designs, sizes, colours and other details may occasionally change.

We will not intentionally substitute a materially different product without informing the customer where such a change would materially affect the purchase.

Nothing in this section limits a consumer’s rights relating to goods that are defective, unsafe, unsuitable or materially different from their description under applicable South African law.

4. Food Products, Ingredients & Allergens

Some products offered through Stay Salty may contain or come into contact with common allergens.

These may include, amongst others, wheat and gluten, milk and dairy products, eggs, peanuts, tree nuts, soy, sesame and other allergens, depending on the particular product.

Customers with allergies, intolerances or specific dietary requirements should carefully review the product and ingredient information supplied and contact us before purchasing if clarification is required.

Although reasonable care may be taken during preparation and production, products prepared in environments where multiple ingredients are handled cannot necessarily be guaranteed to be completely free from traces of allergens unless we expressly state otherwise.

Customers are responsible for following any storage, refrigeration, preparation, use-by, best-before or food-safety instructions supplied with a product.

Nothing in this section limits rights relating to unsafe, defective, incorrectly supplied or materially misrepresented goods.

5. Recipes & Cooking Information

Recipes, cooking methods, baking information, ingredient recommendations and other food-related material published through By The Harris Family are provided for general informational and educational purposes.

Although we take care when developing and sharing our recipes, individual results can vary due to ingredients, equipment, ovens, altitude, environmental conditions, substitutions, technique and other factors outside our control.

Users are responsible for appropriate food hygiene, safe cooking temperatures, correct storage, allergen management and determining whether ingredients or recipes are suitable for themselves and the people for whom they are preparing food.

Recipe and nutritional information, where provided, should be regarded as a reasonable guide rather than medical or dietary advice unless expressly stated otherwise.

By The Harris Family is openly rooted in the Christian faith.

Our Weekly Devotions, prayers, Scripture discussions, personal reflections and other faith-based material represent our beliefs, experiences and understanding of the Christian faith.

This content is shared for encouragement, reflection and spiritual growth.

Faith-based content published on the Website does not constitute medical, psychological, legal, financial or other regulated professional advice.

8. Orders

Placing an order through the Website constitutes an offer to purchase the selected products.

Orders remain subject to product availability, successful payment and acceptance by us.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

a product is unavailable;
incorrect or incomplete customer information has been supplied;
payment cannot be verified;
we reasonably suspect fraudulent activity;
an obvious pricing or product-information error has occurred;
delivery cannot reasonably be completed to the supplied destination; or

If we cancel an order after payment has been received, any amount lawfully due to the customer will be refunded through an appropriate payment method.

9. Prices & Payment

Unless otherwise stated, prices displayed on the Website are in South African Rand (ZAR).

Applicable taxes will be dealt with as required by South African law.

Delivery charges and other applicable charges will be displayed or communicated before completion of the transaction where required.

We reserve the right to change prices from time to time.

A price change will not ordinarily affect an order that has already been accepted, except where permitted by law or where an obvious and genuine pricing error has occurred.

Payments may be processed through third-party payment service providers. The payment provider may apply its own security procedures and terms.

10. Product Availability

Some products may be handmade, produced in small batches, seasonal or stocked in limited quantities.

Adding a product to your cart does not necessarily reserve that item until the order has been successfully completed.

If a product becomes unavailable after an order has been placed, we will contact the customer and offer an appropriate solution. Depending on the circumstances, this may include an agreed substitute, waiting for the product to become available, store credit where voluntarily accepted by the customer, or a refund where appropriate.

11. Delivery & Collection

Delivery and collection options, applicable costs and estimated timeframes will be displayed on the Website or communicated to the customer where applicable.

Delivery dates and times are estimates unless expressly agreed otherwise.

Delays may occasionally occur because of couriers, weather conditions, road conditions, supply interruptions, public holidays, unusually high order volumes or other circumstances outside our reasonable control.

Customers are responsible for providing complete and accurate delivery information.

Where an incorrect or incomplete delivery address causes additional delivery costs or prevents delivery, reasonable additional charges may apply where permitted by law.

12. Returns, Refunds & Exchanges

Returns, refunds and exchanges are governed by our Returns & Refunds Policy together with applicable South African law.

Nothing in these Terms or our Returns & Refunds Policy removes any right or remedy that a consumer is legally entitled to exercise under the CPA, ECTA or other applicable legislation.

Different return or cancellation rules may lawfully apply to certain products, including personalised, custom-made, made-to-order, perishable, food, hygiene-sensitive or digital products.

Defective, unsafe, incorrectly supplied or materially misrepresented products will be dealt with in accordance with applicable consumer law.

13. Personalised, Custom & Made-to-Order Products

Certain Stay Salty products may be personalised, custom-made or produced specifically for a customer after an order has been received.

Customers are responsible for checking names, wording, sizes, colours, quantities and other custom information before submitting their orders.

Once production of a personalised or custom product has begun, cancellation or alteration may not always be possible.

This does not exclude any consumer rights that apply where a custom product is defective, unsafe, materially different from what was ordered, or where a right cannot legally be excluded.

14. Perishable & Fresh Food Products

Certain bakery, fresh-food or other food products may be perishable and may therefore be subject to special collection, delivery, storage and return conditions.

Customers should inspect perishable products as soon as reasonably possible after collection or delivery and contact us promptly if there is a genuine problem with the product.

For health and food-safety reasons, we may not be able to accept the return of food that has been opened, consumed, improperly stored or handled after delivery, except where the product is defective, unsafe, incorrectly supplied or where applicable law provides otherwise.

15. Digital Products & Downloads

The Website may offer downloadable recipes, guides, resources or other digital products.

Unless expressly stated otherwise, purchasing a digital product grants the purchaser a limited right to use that product for personal purposes.

Purchasing a digital product does not transfer ownership of the copyright or other intellectual property contained in it.

Digital products may not be reproduced, resold, redistributed, uploaded, publicly shared or commercially exploited without our prior written permission, except where permitted by law.

Any cancellation or refund rights relating to digital content will be determined in accordance with applicable law and our Returns & Refunds Policy.

16. Salt and Seed Foundation & Giving Back

Salt and Seed Foundation is a separately registered nonprofit organisation and operates independently from Kruidenier Investments and Stay Salty.

By The Harris Family may use the Website to share information about Salt and Seed Foundation, its community work, projects, fundraising activities and ways in which members of the public may become involved.

Where a payment is specifically identified as a donation to Salt and Seed Foundation, it is intended for the Foundation and should not be interpreted as payment to Kruidenier Investments for commercial goods or services.

Purchases of Stay Salty products and other commercial products through the Website are transactions with Kruidenier Investments, unless expressly stated otherwise.

Purchasing a product does not automatically constitute a donation to Salt and Seed Foundation merely because the Website also supports or promotes the Foundation.

Where a particular product, campaign or promotion expressly states that a portion of proceeds will be contributed to Salt and Seed Foundation, the applicable product or campaign information will explain the nature of that contribution.

Any tax treatment or eligibility for a donation receipt will depend on the Foundation’s applicable legal and tax status. We will not represent that a donation qualifies for a particular tax deduction unless Salt and Seed Foundation is legally authorised to provide the applicable documentation.

Unless otherwise stated, original content published on the Website belongs to Kruidenier Investments, By The Harris Family, Stay Salty or the relevant rights holder, as applicable.

To the fullest extent permitted by South African law, Kruidenier Investments will not be liable for indirect or consequential losses resulting solely from circumstances outside our reasonable control, misuse of our products, failure to follow supplied instructions, or reliance on Website content outside the purpose for which it was provided.

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful.

In particular, nothing in these Terms is intended to remove statutory consumer rights relating to the quality, safety, performance, suitability or description of goods or services where those rights apply.
